Who Can Apply for a Online Trademark Registration?

Any Person
A person who isn’t running a business yet can still apply for a trademark and get it registered for a brand name or logo they plan to use in the future.

Steps Involved in The Plan of Trademark Registration

There are several steps involved in the trademark registration process.

The owner also has the right to stop others from using the trademark in those categories and can take legal action if someone uses it without permission.

Selection of a Trademark
When choosing a trademark for your organization, pick something unique and easy to recognize. It's also important to know which category your business falls into. There are 45 categories in total: Classes 1–34 are for products, and Classes 35–45 are for services.
Search for The Mark
Once you've chosen a mark, it's important to check if a similar one is already registered. You can do this yourself by visiting the Controller General's website for Patents, Designs, and Trademarks. There’s a public search option on the site. After choosing this option, select your class and search the online database.
Application Submission
You can apply for multiple classes, series, or collective trademarks with a single application using Form TM-A. This form lets you register your trademark in more than one category. There are two different fee levels:

1. 9,000 or 10,000 rupees: If you're not a start-up, small business, or individual, you'll fall into this category. The fee is 9,000 rupees if you file the form online, or 10,000 rupees if you submit it in person at the TradeMarks Office.
2. 4,500 or 5,000 rupees: This fee is for individuals, small businesses (with MSME registration), and start-ups. If you file the form online, the cost is 4,500 rupees, or 5,000 rupees if you file it in person.
It's important to fill out the form carefully to avoid delays or rejection. You need to provide all the required information and include a trademark image that is 9 by 5 cm. You may also need to submit five copies of the document. When filing, the complete file must be provided with two extra copies.
Vienna Codification Procedure
The Vienna Categorisation, also called the Vienna Codification, is a system used worldwide to classify the visual elements of trademarks. It was created under the Vienna Agreement in 1973. After someone applies to register a trademark, the Trademark Registrar uses the Vienna Classification to categorize the visual parts of the trademark. During this process, the status of the trademark application is usually shown as "Sent to Vienna Codification."
